Terms of Service

1. Acceptance of Terms
By accessing or using the StayStack platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the platform. These terms constitute a legally binding agreement between you (or the entity you represent) and Encrobytes Technologies Pvt. Ltd.
2. The Service
StayStack is a cloud-based hospitality management platform that includes property management, channel management, revenue management, booking engine, CMS, CRM, analytics, and related modules. The specific modules available to you depend on your subscription plan. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at ping@encrobytes.com if you suspect any unauthorised access to your account.
4. Subscriptions & Payment
StayStack is offered on a subscription basis. Fees are billed in advance on the agreed billing cycle (monthly or annual). All fees are exclusive of applicable taxes (including GST). Failure to pay may result in suspension of access. We do not offer refunds for partial periods, except where required by applicable law.
5. Acceptable Use
You agree not to: • Use the platform for any unlawful purpose or in violation of any regulations • Attempt to gain unauthorised access to any system or network • Upload malicious code, viruses, or disruptive content • Reverse engineer, decompile, or attempt to extract source code • Resell or sublicense access to the platform without our written consent • Misrepresent your identity or affiliation when using the platform
6. Data Ownership
You retain full ownership of all data you input into the platform (including property data, guest data, and operational data). You grant us a limited licence to process this data solely to provide the service. We do not claim any ownership over your data and will not use it for any purpose beyond providing and improving the platform.
7. Intellectual Property
All intellectual property rights in the StayStack platform — including software, design, trademarks, and documentation — are owned by Encrobytes Technologies Pvt. Ltd. These terms do not grant you any rights to our intellectual property beyond the limited licence to use the platform during your active subscription.
8. Third-Party Integrations
The platform may integrate with third-party services (OTAs, payment gateways, accounting software, etc.). Your use of these integrations is subject to the third party's own terms and conditions. We are not responsible for the performance, availability, or practices of third-party services.
9. Uptime & SLA
We target 99.9% platform uptime, excluding scheduled maintenance windows (announced in advance) and events beyond our reasonable control. In the event of downtime exceeding our SLA, you may be eligible for service credits as outlined in your order agreement.
10. Limitation of Liability
To the maximum extent permitted by law, StayStack and Encrobytes Technologies Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim shall not exceed the fees paid by you in the 3 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Encrobytes Technologies Pvt. Ltd., its officers, directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the platform, your breach of these terms, or your violation of any third-party rights.
12. Termination
Either party may terminate the subscription at the end of the current billing period with written notice. We may terminate or suspend your account immediately if you breach these terms. Upon termination, you may request an export of your data within 30 days. After that period, we may delete your data in accordance with our data retention policy.
13. Governing Law
These terms are governed by the laws of India. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
14. Changes to These Terms
We may update these Terms of Service from time to time. We will provide at least 30 days' notice of material changes via email or an in-app notice. Continued use of the platform after the effective date of changes constitutes acceptance of the updated terms.
